Setanta Judgement Welcome

The High Court has ruled that the Motor Insurer’s Bureau of Ireland are liable liable in respect of claims against the policyholders of the insolvent insurance companies such as Setanta Insurance Company Ltd ( in liquidation) (‘Setanta’) This decision now means that the MIBI will be responsible for claims against persons who were insured with Setanta at the time of their entry into liquidation in April 2004. The uncertainty surrounding the issue of who was liable to pay for those who suffered injury and or loss as a result of an accident caused by a Setanta insured individual (or indeed any other insurer who has become insolvent since an accident) has now been determined. The Judgement is a welcome one by all those who have claimed against an a Setanta insured individual and means that any compensatory awards made in favour of a Plaintiff involved in an accident against a Setanta insured individual will now be paid by MIBI. MIBI may well appeal the decision and if this is the case the situation will be left in further abeyance for quite some time.
